La investigación policial del crimen organizado en España

Abstract

La criminalidad organizada supone un reto para la sociedad actual siendo considerado uno de los principales problemas de seguridad tanto para la Unión Europea como para el gobierno de España. El propio concepto del crimen organizado constituye un desafío tanto desde el punto de vista académico como el judicial y policial, debido a los diferentes aspectos sociales, económicos, legales o políticos involucrados. En esta revisión se tratará de analizar el estado actual del crimen organizado en Europa y España, su actual regulación legal y las actividades ilícitas que realiza, así como de efectuar un recorrido por las diferentes técnicas y procedimientos de investigación policial existentes contra la criminalidad organizada, y todo ello con el fin de evaluar su efectividad y conocer los aspectos que inciden en el valor probatorio de sus resultados ante las Autoridades Judiciales.

Organized crime represents a challenge for current societies being one of the main security problems for both the European Union and the government of Spain. The very concept of organized crime also represents a challenge from an academic, judicial and police point of view due to the different social, economic, legal or political aspects it involves. This review will attempt to analyze the current situation of organized crime in Europe and Spain, its legal regulation and the illicit activities it carries out, as well as takes a tour throughout the different police investigation techniques and procedures against organized crime in order to evaluate its effectiveness and the aspects that affect the probative value of its results before the Judicial Authorities.
