Defensa de un Estado ante la Corte Interamericana de Derechos Humanos. Estudio de una caso hipotético: Emilio Acosta vs. Arcadia

Abstract

En el presente Trabajo de Fin de Grado se desarrollará la defensa de un Estado en un caso hipotético ante la Corte Interamericana de Derechos Humanos sobre el aborto. En el caso están en juego distintos derechos recogidos en la Convención Americana de Derechos Humanos: derecho a la vida (art. 4), derecho garantías y protección judicial (arts. 8 y 25), protección de la honra y la dignidad (art.11), protección a la familia (art. 17), derechos del niño (art. 19) e igualdad ante la ley (art. 24). El trabajo se ha elaborado como producto de la participación de un equipo de la Universidad Miguel Hernández de Elche en la V Competición en litigación internacional organizada por la Universidad de Alcalá (Madrid, España) junto a la Universidad Militar de Nueva Granada (Bogotá, Colombia).

In this Final Degree Project the defense of a hypothetical state before the Interamerican Court of Human Rights on abortion will be developed. In the case, different rights included in the American Convention on Human Rights are at stake: Right to Life (art. 4), Right to a Fair Trial and Right to Judicial Protection (arts. 8 and 25), Right to Privacy (art. 11), Rights of the Family (art. 17), Rights of the Child (art. 19) and Right to Equal Protection (art. 24). The work has been developed as a result of the participation of a team from the Miguel Hernández University of Elche in the V Competition in international litigation organized by the University of Alcalá (Madrid, Spain) together with the Military University of Nueva Granada (Bogotá, Colombia).
