Ultrajes a la bandera vs libertad de expresión.

Abstract

De acuerdo con la posición del TC, los ultrajes a la bandera de España no están amparados en el ejercicio del derecho a la libertad de expresión. Las expresiones “Aquí tenéis el silencio de la puta bandera” y “hay que prenderle fuego a la puta bandera” son innecesarias para las reivindicaciones salariales que se estaban defendiendo por el recurrente, como representante del Sindicato (Confederación Intersindical Galega), y no guardaban relación con dichas reivindicaciones.

According to the position of the TC, outrages to the Spanish flag are not protected by the exercise of the right to freedom of expression.
