El sistema de etiquetado frontal en alimentos y bebidas preenvasadas en México, mecanismo para garantizar el derecho a la salud y su relación con las empresas

Abstract

El Sistema de Etiquetado Frontal de Alimentos y Bebidas Preenvasadas en México consiste en implemen-tar una medida legislativa mediante la cual se combata el sobrepeso y la obesidad, finalidad inmediata que encuentra sustento en el artículo cuarto párrafos tercero y cuarto, de la Constitución Política de los Estados Unidos Mexicanos. Por lo tanto, no afecta el derecho de igualdad de las empresas en cuanto a la libertad de comercio. Pues, dicha medida legislativa consiste en que el Estado garantice a toda persona el derecho a una alimentación nutritiva, suficiente y de calidad, hacer efectivo el derecho a la protección de la salud y el derecho a la información de la población

The Front Labeling System for Prepackaged Food and Beverages in Mexico consists of implementing a legislative measure to combat overweight and obesity, an immediate purpose that is supported by the fourth paragraph, third and fourth paragraphs of the Political Constitution of the United Mexican States. Therefore, it does not affect the right of equality of companies in terms of freedom of trade. Thus, this legislative measure consists of the State guaranteeing everyone the right to nu-tritious, sufficient and quality food, making effective the right to health protection and the right to information of the population
