After reviewing the notion of corruption
and the normative texts considered as anti-corruption
legislation in Spain and the most significant legal
spheres where it is generated and manifested, the
article focuses on the public aid sector, highlighting
what the regulations are and the more relevant
reports that have had an impact on said problem.
Immediately afterwards, three major subsectors
stand out in which corruption has become more
evident (those integrated in the so-called macro
case of the EREs of the Junta de Andalucía; that
of indirect aid to the social media, through institutional
advertising; and social housing). Next,
an introductory analysis is carried out on the application of the principle of equality and its
corollaries proclaimed in section 8.3 Of act
38/2003, as a basis for the prescriptions to avoid
or reduce corruption: Finally, 13 proposals are
collected to prevent or reduce corruption in the
analyzed sector (setting clear and precise prior
evaluation criteria; that the evaluation criteria are
not discriminatory, etc.).
