Nuevas tecnologías, poder de control empresarial

Abstract

El objetivo de este trabajo es analizar el avance del poder de control-empresarial con el uso de las nuevas tecnologías y las redes sociales. Veremos cómo el empresariado ejerce el mismo y cómo afecta al trabajador tanto en su aspecto personal y laboral. Se tratará de analizar las posibles vulneraciones de derechos que se realizan bajo el amparo de funciones de vigilancia y control por parte del empresariado. Del análisis efectuado se podrá extraer en qué medida están siendo afectados los derechos de los trabajadores y cómo actualmente se está a expensas de una jurisprudencia variable ante la falta de regulación que normativice esta potestad empresarial reconocida igualmente por nuestra Constitución.

The objective of this work is to analyze the advance of the control-business power with the use of new technologies and social networks. We will see how entrepreneurship exercises the same and how it affects the worker both in their personal and work aspect. It will try to analyze the possible violations of rights that are carried out under the protection of surveillance and control functions by the business community. From the analysis carried out it will be possible to extract to what extent the rights of the workers are being affected and how it is currently at the expense of a variable jurisprudence in the absence of regulation that regulates this business power also recognized by our Constitution.
