Abstract:
La prueba testifical constituye uno de los medios probatorios más relevantes en el proceso penal, especialmente en aquellos delitos en los que la declaración de la víctima o de los testigos presenciales adquiere una importancia decisiva para el esclarecimiento de los hechos. Sin embargo, su valoración plantea importantes dificultades derivadas de la naturaleza fiable de la memoria humana y de la necesidad de garantizar los derechos fundamentales de las partes. El presente trabajo analiza el régimen jurídico de la prueba testifical en el proceso penal español, abordando su concepto, el estatuto jurídico del testigo y la práctica de la declaración tanto en la fase de instrucción como en el juicio oral. Asimismo, se estudian los criterios jurisprudenciales de valoración de la prueba testifical, con especial atención a aquellos supuestos en los que las circunstancias personales del declarante exigen una valoración reforzada. Finalmente, se incorpora una breve perspectiva de derecho comparado y se examinan algunos de los principales desafíos actuales relacionados con la fiabilidad del testimonio y la protección de los testigos vulnerables.
The testimonial evidence is one of the most relevant evidence in criminal proceedings, especially in those crimes in which the statement of the victim or the eyewitnesses acquires a decisive importance for the clarification of the facts. However, its assessment raises important difficulties arising from the fallible nature of human memory and the need to guarantee the fundamental rights of the parties. This work analyzes the legal regime of testimonial evidence in the Spanish criminal process, addressing its concept, the legal status of the witness and the practice of the statement both in the investigation phase and in the oral trial. Likewise, the jurisprudential criteria for the assessment of the testimonial evidence are studied, with special attention to those cases in which the personal circumstances of the declarant require a reinforced assessment. Finally, a brief comparative law perspective is incorporated and some of the main current challenges related to the reliability of testimony and the protection of vulnerable witnesses are examined.
