Situación de los animales en las crisis matrimoniales

Abstract

A lo largo de los siglos la sociedad ha ido evolucionando y con ello el concepto de animal doméstico se ha visto modificando, pasando de ser objetos utilizados únicamente para trabajos de fuerza a ser verdaderos miembros de las familias y ostentando un papel clave. Junto con la evolución del termino animal las leyes se han ido modificando para adaptarse a la nueva realidad, por esta evolución es que aparece la Ley 17/2021 por la que se modifica el Código Civil y con él la forma en la que se resuelven los conflictos matrimoniales en temas de custodia de los animales. Así, la propiedad del animal deja de ser lo más relevante y pasa a serlo el bienestar del mismo.

Over the centuries, society has evolved and the concept of domestic animal has changed with it, shifting from objects used only for labor to true members of the family with an important role. Along with the evolution of the term animal laws have been modified to adapt the new reality. This evolution has propitiated the Law 17/2023 which modifies the Civil Code, this law resolves marital disputes. The most important right now is the well-being of animal.
