Ley de Bienestar Animal

Abstract

En el presente trabajo de fin de grado se exponen las principales leyes que regulan aspectos como el bienestar animal, los principios y derechos que rigen el trato hacia los animales y el actual concepto de animal de compañía, entendido éste como un ser sintiente. Se estudia también la distribución, prescripción, dispensación y uso de medicamentos veterinarios entre otras consideraciones a tener en cuenta, como el cambio de regulación de la Ley hipotecaria, la Ley de enjuiciamiento civil, el derecho de familia y el derecho de sucesiones. Con el trabajo de investigación pretendo concienciar a toda aquella persona interesada, del numeroso abanico de derechos que los animales han ido adquiriendo a lo largo de la historia, siendo ampliados o disminuidos dependiendo del momento, cultura e ideología imperante en cada momento. Principalmente, me enfoco en el marco jurídico de nuestros días, pero para ello he realizado un breve paseo por la historia y una breve comparación con otros marcos jurídicos de los países de nuestro alrededor para poner en contexto a toda persona atraída en el contenido de este trabajo. La metodología empleada para dar sentido al contenido se compone del estudio de la Ley 17/2021, de 15 de diciembre, de modificación del Código Civil, la Ley Hipotecaria y la Ley de Enjuiciamiento Civil, sobre el régimen jurídico de los animales. Incluye también un estudio de la Ley 7/2023, de 28 de marzo, de protección de los derechos y el bienestar de los animales. Además, se examina muy brevemente el Real Decreto 666/2023, de 18 de julio, por el que se regula la distribución, prescripción, dispensación y uso de medicamentos veterinarios. Todo ello acompañado de jurisprudencia, artículos de revistas, informes de especialistas y otras fuentes fiables. Como resultado de la investigación, se llega a comprender la importancia que los animales han adquirido en la sociedad actual, se comienza a discernir el porqué era necesaria la imperante regulación sobre los diferentes derechos que por naturaleza, les pertenecen. Considero que, con la lectura del documento, se conseguirá adquirir un conocimiento básico sobre el trato hacia los animales, los diversos procedimientos que hay que seguir para poder adquirir una mascota, los derechos que tienen las mismas en diversos momentos de nuestra vida y el porqué de las últimas polémicas entre profesionales del sector veterinario respecto a la dispensación de medicamentos.

In this final degree project, the main laws regulating aspects such as animal welfare, the principles and rights that govern the treatment of animals, and the current concept of companion animals, understood as sentient beings, are presented. The study also examines the distribution, prescription, dispensing, and use of veterinary medicines, among other considerations to take into account, such as changes to the regulation of the Mortgage Law, the Civil Procedure Law, family law, and inheritance law. With this research work, I aim to raise awareness among all interested individuals about the extensive range of rights that animals have acquired throughout history, which have been expanded or diminished depending on the time, culture, and prevailing ideology. Primarily, I focus on the legal framework of our days, but to do this I have taken a brief walk through history and a brief comparison with other legal frameworks of the countries around us to provide context for anyone attracted to the content of this work. The methodology employed to give meaning to the content consists of the study of Law 17/2021, of December 15, which amends the Civil Code, the Mortgage Law, and the Law of Civil Procedure regarding the legal regime of animals. It also includes a study of Law 7/2023, of March 28, concerning the protection of the rights and welfare of animals. Additionally, the Royal Decree 666/2023, of July 18, which regulates the distribution, prescription, dispensing, and use of veterinary medicines, is examined very briefly. All of this is accompanied by case law, articles from journals, reports from specialists, and other reliable sources. As a result of the research, it becomes clear the importance that animals have acquired in current society, and one begins to discern why it was necessary to have imperative regulations regarding the different rights that naturally belong to them. I believe that by reading the document, one will gain a basic understanding of the treatment of animals, the various procedures to follow in order to acquire a pet, the rights they have at different moments in our lives, and the reasons behind the recent controversies among professionals in the veterinary sector regarding the dispensing of medications.
