Los mecanismos de Prevención de Riesgos Laborales en las nuevas formas de trabajo digital: el teletrabajo

Abstract

En este trabajo hemos hecho un recorrido por trabajos publicados por diferentes autores que tratan en general sobre el teletrabajo, la Prevención de Riesgos Laborales y cuáles son los mecanismos preventivos que pueden aplicarse. Este cometido lo hacemos desde la definición del teletrabajo, principalmente distinguiéndolo del trabajo a distancia, la revisión de un caso práctico concreto, el estudio de los diferentes tipos de riesgo que pueden darse y la delimitación del accidente de trabajo en esta modalidad de desarrollo de la actividad laboral. La finalidad con la que se realiza este TFM es la de arrojar un poco de luz sobre los mecanismos preventivos existentes en el teletrabajo, cuyo origen lo encontramos en la normativa vigente. Asimismo, también se pretende encontrar otras propuestas de mejora que los diferentes autores hacen para paliar posibles lagunas que puedan existir actualmente en los mecanismos establecidos. Los resultados que se han alcanzado son, por un lado, efectivamente comprobar como el legislador ha ido estableciendo una serie de medidas preventivas que aparecían como respuesta al avance del teletrabajo y, por otro lado, identificar posibles mejoras que se podrían aplicar para tener una mayor protección de la seguridad y salud de los teletrabajadores. En conclusión, se podría aplicar nuevos mecanismos preventivos como la ampliación del ámbito espacial de la evaluación de riesgos, no solo al espacio dedicado al teletrabajo sino a todo el domicilio si se estima necesario, dar una mayor relevancia a los riesgos psicosociales, formar a los trabajadores en el uso de las TIC o, en relación con la violencia o el acoso digital en el ámbito laboral, establecer campañas de concienciación o realizar acciones de diagnóstico previo en esta materia.

In this work we have reviewed works published by different authors that deal in general with teleworking, Occupational Risk Prevention and what preventive mechanisms can be applied. We carry out this task from the definition of teleworking, mainly distinguishing it from remote work, the review of a specific practical case, the study of the different types of risk that can occur and the delimitation of the work accident in this type of development of the labour activity. The purpose with which this TFM is carried out is to shed a little light on the existing preventive mechanisms in teleworking, whose origin is found in current regulations. Likewise, it is also intended to find other improvement proposals that different authors make to alleviate possible gaps that may currently exist in the established mechanisms. The results that have been achieved are, on the one hand, to effectively verify how the legislator has established a series of preventive measures that appeared in response to the advance of teleworking and, on the other hand, to identify possible improvements that could be applied to have greater protection of the health and safety of teleworkers. In conclusion, new preventive mechanisms could be applied such as expanding the spatial scope of risk assessment, not only to the space dedicated to teleworking but to the entire home if deemed necessary, giving greater relevance to psychosocial risks, training workers in the use of ICTs or, in relation to violence or digital harassment in the workplace, establish awareness campaigns or carry out prior diagnostic actions in this matter.
