Análisis de la documentación referente a coordinación de actividades empresariales y diseño de base de datos para el control documental

Abstract

La coordinación de actividades empresariales (CAE) engloba un cómputo de trámites burocráticos al cual se deben de enfrentar las grandes empresas en su día a día. La necesidad legal de las organizaciones de coordinarse en materia de seguridad y salud en el trabajo viene establecida en el Art.24 de la Ley de Prevención de Riesgos Laborales, donde se indica que “cuando en el mismo centro de trabajo desarrollen actividades trabajadores de dos o más empresas, estas deberán cooperar en la aplicación de la normativa de prevención de riesgos laborales” y que “el empresario titular del centro de trabajo adoptará las medidas necesarias para que aquellos otros empresarios que desarrollen actividades en su centro de trabajo reciban la información y las instrucciones adecuadas”. Cuanto más grande es la empresa, mayor es su volumen de subcontratas, y mayor se vuelve la complejidad de llevar al día toda la documentación referente a la CAE. Es por este motivo que el presente TFM tiene el principal objetivo de recopilar y tabular todos los documentos necesarios que se llevan a cabo en la CAE para que sirva de recurso a cualquier técnico de prevención. Además, se analiza la creación de una base de datos de consulta de documentación en vigor con las diferentes empresas con las que se disponga de relación laboral. Además, en los últimos años se han desarrollado diferentes herramientas de terceros, basadas en la nube, que permiten una interacción de CAE entre empresa-subcontrata de manera totalmente digital. Se analizarán algunas de estas opciones del mercado actual, así como sus ventajas e inconvenientes. Finalmente, se realiza un análisis de las consecuencias legales de no llevar a cabo la gestión de la CAE.

The coordination of business activities (CAE) includes a number of bureaucratic procedures that large companies have to face on a daily basis. The legal need for organizations to coordinate in matters of safety and health at work is established in Art. 24 of the Law on Prevention of Occupational Risks, which indicates that “when workers from companies carry out activities in the same workplace, or more companies, these must cooperate in the application of the regulations for the prevention of occupational risks" and that "the employer who owns the workplace will adopt the necessary measures so that other employers who carry out activities in their workplace receive the information and appropriate instructions”. The larger the company and the greater the volume of subcontractors, the greater the complexity of keeping up to date all the documentation related to the CAE. It is for this reason that this TFM has the main objective of collecting and tabulating all the necessary documents that are carried out in the CAE so that it can serve as a resource for any prevention technician. In addition, the creation of a database for consulting current documentation with the different companies with which there is an employment relationship is analyzed. Additionally, in recent years, different cloud-based third-party tools have been developed that allow CAE interaction between company and subcontractor in a completely digital way. Some of these options on the current market will be analyzed, as well as their advantages and disadvantages. Finally, an analysis of the legal consequences of not carrying out the management of the CAE is carried out.
