El acceso al mercado español de los empresarios autónomos extranjeros

Abstract

Este trabajo tiene como objetivo analizar, desde la perspectiva del Derecho de Extranjería en España, las condiciones legales exigidas para que los extranjeros puedan adquirir la condición de autónomos. Para cumplir con este objetivo, se analizan brevemente los diferentes supuestos legales previstos para el acceso al trabajo por cuenta propia por parte de los extranjeros, tanto residentes como no residentes, y posteriormente, se analizan las deficiencias que presenta el sistema y las condiciones de su aplicación.

The purpose of this paper is to analyze, from a critical perspective, the legal conditions provided by the Spanish Immigration Law to obtain the authorization to work as a self-employed for foreigners. In order to fulfill the proposed objective, first I start by analyzing, from a general perspective, the characteristics of the system. The different scenarios foreseen for access to self-employment by foreigners, both residents and non-residents, are briefly analyzed below. Finally, the deficiencies presented by the system and the conditions of its application are analyzed.
