The aim of this work is to analyze the impact of the labor reform approved by the Royal Decree-law 32/2021, of December 28, on labor societies, as well as to propose some measures to improve the development and functioning of these social economy enterprises. To do this, it is assumed that the labor reform implies a normative change that affects the conditions of hiring, collective bargaining and subcontracting in labor societies, which can have positive or negative consequences for their competitiveness, stability and participation.
To test this hypothesis, a bibliographic review of the main legal and academic sources on labor societies and the labor reform is carried out. Next, the most relevant aspects that affect labor societies in terms of temporary hiring, training contracts, fixed-discontinuous contracts, fixed-work contracts, collective agreements, ultra-activity, contracts and subcontracts are identified. The possible effects of these normative changes on the characteristics, advantages and disadvantages of labor societies are evaluated.
Finally, a series of proposals for reforming law 44/2015 are developed to improve the development and functioning of labor societies. These proposals are based on the principles and values of the social economy and seek to enhance the participation of workers in the social capital, decision-making and entrepreneurship.
