La ley de mediación de la Comunidad Valenciana

Abstract

La mediación en España tiene ya un recorrido importante desde la aprobación en 2012 de la ley estatal de mediación, a raíz de la cual se aprobó seis años más tarde la vigente Ley 24/2018 de 5 diciembre de mediación de la Comunidad Valenciana, sobre la cual voy a realizar un estudio crítico y comparativo respecto a otras normas autonómicas de mediación, con el fin de ver sus diferencias en cuanto a su aplicabilidad y efectividad. A su vez, basándome en los informes estadísticos de los que se dispone en la actualidad de los distintos organismos de mediación, tanto a nivel autónomo valenciano como a nivel estatal, podremos concluir si la mediación está cumpliendo sus funciones y consiguiendo alguna de sus finalidades. Por otra parte, veremos qué modelos existen y se utilizan en la mediación, dependiendo de la relación entre las partes en conflicto, ya que cada tipo de conflicto requiere de un modelo adecuado para su resolución. En esa resolución de los conflictos a través de la mediación, existen las figuras importantes de los mediadores, sin los cuales la mediación no podría tener lugar, ya que son los que tienen los conocimientos y formación adecuados para reconducir el conflicto hacia un acuerdo, siempre que las partes colaboren y realmente se impliquen. Pero en la legislación sobre mediación no se tiene en cuenta a otra figura que ejerce su función de mediador en la sociedad y que probablemente sea la primera o de las primeras en tener conocimiento de los conflictos ocurridos en nuestros municipios, y en muchas ocasiones la única. Estoy hablando de la labor que desempeña la Policía Local como mediador, a mi parecer un papel importantísimo y fundamental, del cual puede depender que el conflicto se resuelva incluso sin tener que llegar a la mediación, o en caso de tener que acudir a esta vía, que las partes estén bien informadas. Por ello, una buena gestión de la mediación por parte de las Fuerzas y Cuerpos de Seguridad es fundamental.

Mediation in Spain has already come a long way since the approval in 2012 of the state mediation law, as a result of which the current Law 24/2018 of December 5 on mediation of the Valencian Community was approved six years later, on the which I am going to carry out a critical and comparative study with respect to other autonomous mediation regulations, in order to see their differences in terms of their applicability and effectiveness. In turn, based on the statistical reports that are currently available from the different mediation bodies, both at the autonomous Valencian level and at the state level, we will be able to conclude whether the mediation is fulfilling its functions and achieving any of its purposes. On the other hand, we will see what models exist and are used in mediation, depending on the relationship between the parties in conflict, since each type of conflict requires an adequate model for its resolution. In this resolution of conflicts through mediation, there are the important figures of mediators, without whom mediation could not take place, since they are the ones with the appropriate knowledge and training to redirect the conflict towards an agreement, always that the parties collaborate and really get involved. But the legislation on mediation does not take into account another figure who exercises his role as mediator in society and who is probably the first or among the first to be aware of the conflicts that have occurred in our municipalities, and on many occasions the only one. I am talking about the work carried out by the Local Police as a mediator, in my opinion a very important and fundamental role, on which it may depend that the conflict is resolved even without having to go to mediation, or in case of having to resort to this route that the parties are well informed. For this reason, good mediation management by the Security Forces and Bodies is essential.
