Estudio crítico del sistema legal de acceso a la residencia de los menores hijos de residentes legales en España

Abstract

El presente trabajo se dirige a realizar un estudio, desde una perspectiva práctica, sobre las diferencias que existen entre los procedimientos legales previstos para otorgar la residencia legal a los menores de padres extranjeros residentes en España que nacen en España respecto de los hijos de extranjeros residentes en España, que han nacido en el extranjero. Veremos, cómo siendo residentes en España los padres tienen que actuar de una forma si se trata de un hijo que nace en España respecto de si nace en el extranjero, es decir, se trata de plasmar la diferencia de requisitos que se les exige según el caso y la injusticia que está detrás de la aplicación de esta normativa.

This is to carry out a study, from a practical perspective, on the differences that exist between the procedures to grant legal residence to the minors of foreign parents residing in Spain who are born in Spain and of the children of foreigners who reside in Spain, but those that are born outside the country. We will see, how being residents in Spain, parents have to act in a way if it is a child born in Spain compared to if it is born abroad, that it is a matter of reflecting the difference in requirements that are required of them according to the case and the injustice behind the application of this regulation.
