This paper attempts to explain which are the situations and peculiarities that could arise in cases of International Matrimonial Matters within the framework of the European Union, and how are they solved taking into account the Regulation (EC) 2201/2003 (or Regulation “Brussels II bis”) and the national regulation of the Member States if applicable: both “solutions” deal with the attribution of international judicial jurisdiction: the first one granting it to the legal systems of a Member State, and the second one attributes such competence to the internal Courts that have conection with the matter, when the Regulation is not applied. Regarding the applicable law, Regulation (EC) 1259/2010 (or Regulation “Rome III”) is taken into account, the realization of the same and the assumptions that are not applicable. Likewise, is analyzed the applicable law in cases of divorce, legal separation, marriage annulment.
