This investigation work, within the framework of the evolution of the maternity benefit, focuses on the law that established compulsory maternity insurance which was one of the most important rules in labour standards, since its appearance has suffered different modifications and advances since its origin in 1900. We will focus on the moment when the insurance was created, which was during the dictatorship of Primo de Rivera and specifically during the establishment of the civil directory. We must take into account the effects of the industrial revolution on the working class, since the introduction of new machines, war conflicts and in general the social situation was changing and in consequence a situation of legal helplessness arose and more in the case of women since they had the handicap of gestation and raising children in precarious situations. This provoked a multitude of protests and incidents, some with serious consequences, which made the governors aware of the situation. We will also analyse all those legislative provisions protecting maternity in their dual aspects. One relates to the employment contract: obligatory rest before and after childbirth, breastfeeding leave and protection of employment during their absence and another social security measure such as maternity benefits, taking into account the influence of foreign countries and mentioning the role of syndicates. Finally, we will also make a brief reference to the current situation
