Resumen :
La nueva forma de consumir la información está a un solo click. Con la implantación del Internet, la información se ha convertido en un flash de datos que cualquier empresa puede conseguir de inmediato. Pero una nueva ley de derechos de autor se acaba de aprobar en el parlamento europeo. Se trata de un proyecto iniciado ya en el año 2016 por el eurodiputado Axel Voss. En aquel entonces recibió un gran rechazo, pero ahora, tres años más tarde la propuesta volvió a la Comisión de Asuntos Jurídicos del Parlamento Europeo. Tras llegar a un consenso por tercera vez, el parlamento europeo lo aprobó con 348 votos a favor y 274 en contra, habiendo 36 abstenciones. Los expertos y los ciudadanos de la Unión Europea advierten que esta nueva ley de copyrights acabará con la libertad de expresión. Esta es la Directiva (UE) 2019/790 del Parlamento Europeo y del Consejo de 17 de abril de 2019 sobre los derechos de autor y derechos afines en el mercado único digital y por la que se modifican las Directivas 96/9/CE y 2001/29/CE que se basa en el artículo 11: que manifiesta que los sitios webs tendrán que pagar un canon por la utilización de fragmentos de otras obras u otros medios como periódicos o revista, o por enlazar links en sus textos. Luego, está el artículo 13 que pretende pasar toda la responsabilidad a las grandes plataformas como Google, Facebook, Youtube, Instagram etc. Estas tendrán que controlar el contenido que cada usuario sube a su plataforma. Por este motivo, este Trabajo de Fin de Grado analizará los detalles de esta nueva ley de copyrights, principalmente como afectará a la red de información. La línea principal que se va a seguir en esta investigación es una metodología que explicará los cambios que tendrán que llevar a cabo la red Internet, y como afectan estos cambios a la libertad de expresión e información.
The new way of consuming information is a single click. With the introduction of the Internet, the information has become a flash of data that any company can get immediately. But a new copyright law comes into force. It is a project started in 2016 by the Axel Voss MEP. At that time, he received a great rejection, but now, four years later the proposal returned to the Legal Affairs Committee of the European Parliament. After reaching a consensus for the third time, the European Parliament approved it with 348 votes in favor and 274 against, with 36 abstentions. Experts and European Union citizens warn that this new law of copyrights will end freedom of expression. This is the Directive (EU) 2019/790 of the European Parliament and of the Council of 17 April 2019 on copyright and related rights in the digital single market and amending Directives 96/9/EC and 2001/29/EC on the basis of Article 11: where it stands out that the websites will have to pay a fee for the use of fragments of other works or other media such as newspapers or magazines, or by linking links in their texts. Then, there is Article 13 that aims to pass all the responsibility to large platforms such as Google, Facebook, YouTube, Instagram etc. These will have to control the content that each user uploads to their platform. For this reason, this Final Degree Project will analyze the details of this new copyrights law, mainly as it will affect the information on Internet. The main line that will be followed in this research is a methodology that will explain what changes they will have to carry out once this new law is applied and how these changes affect the freedom of expression and information.
