In this work, the aim is to reflect on the problem of gender violence from the victim's point of view, taking into account that society is more aware of this problem, as the fight against this scourge affects everyone.
The two objectives of this work are, firstly, to demonstrate that gender violence is a phenomenon that does not end with the arrest of the aggressor, or even with the denunciation of the aggressor, since the victim is not a mere external witness to what happened, she has not only seen an event, but has suffered it.
The second objective is to make it clear how necessary it is for local police forces in their respective municipalities, regardless of whether they are large or small towns, to have models for the formation of specific groups in the fight against gender-based violence.
In it, the concept of gender violence is explained and a review of the existing regulations in our country up to the present day is carried out, with the central axis being Organic Law 1/2004, of 28 December, on Integral Protection Measures against Gender Violence1.
It is for this reason that we will emphasise the treatment that the victim receives, at the very moment the crime occurs, from the police, being the first representation that the victim has contact with the Public Administration.
The victim has a series of basic rights such as support, assistance, information, attention, as well as the right to actively participate in the process and to receive professional, respectful, individualised and non-discriminatory treatment from the first contact with the authorities or officials, focusing, therefore, in this work, on the action, since this first contact with the victim will mark the way for the victim to declare, not to withdraw the complaint, not to retract the complaint.....
We will study the protocol for police action in cases of gender violence, as well as the police assessment of the victim's risk, without forgetting the social and legal aspects of this problem and criticising article 416 of the Criminal Procedure Act2.
