Análisis ético constitucional de la gestación subrogada

Abstract

Aquí se presenta un análisis desde un punto de vista tanto ético como constitucional, relativo al contrato de gestación subrogada, prohibido expresamente en España. Vamos a investigar sobre la adecuación de este método a nuestro estado de derecho, si es necesaria e imprescindible su regularización y si resulta deseable. Así mismo, investigaremos sobre el efecto que tiene la gestación por sustitución en la mujer portadora y en el bebé gestado, así como el vínculo que se puede establecer entre ambos. Y por último, vamos a poner sobre la mesa si es posible una regulación y los términos en los que esta sería viable para que se garantizaran los derechos fundamentales. Vamos a ofrecer una visión sobre el fondo del asunto que ayude a comprender el tema tratado y nos lleve a obtener una visión crítica, pues es de la única manera que se puede alcanzar una conclusión certera y correcta que nos lleve a la obtención del conocimiento.

This analysis is presented from an ethical and constitutional point of view, regarding the surrogate pregnancy contract, expressly prohibited in Spain. We will investigate the adequacy of this method to our state of law, if it is necessary and essential to regularize it and if it is desirable. Likewise, we will investigate the effect of pregnancy by substitution on the carrier woman and the gestated baby, as well as the link that can be established between them. And finally, we are going to put on the table if a regulation is possible and the terms in which this would be viable so that fundamental rights were guaranteed. We will offer a view on the merits of the matter that will help us to understand the subject matter and lead us to obtain a critical vision, since it is the only way that we can reach an accurate and correct conclusion that leads us to obtain knowledge.
