In the center of the criminal process, analyzing the differents situacions of this, the debate
arrives about who is the most important, the strong of the State or the respect for the
fundamental rights of citizens. In my opinion, it is evident that there are situations in
which a citizen commits a criminal act, and although the presumption of innocence
prevails in the process, it must not be placed before the public good or social peace.
Limiting a fundamental right in the process is necessary, because we must not forget that
what can bring us closer to a criminal is its most intimate circle. The fundamental Rights
they must be limited for manage justice to the people who commit crime, because if not
limitated the fundamental rights, more offenses will be unpunished. The debate is created
by a double slope, the obligation to provide justice on the part of the State and the
obligation to respect the fundamental rights of the subject. To advance properly in this
work, is it so finding the requirements of the limitation, such as legality, jurisdictionality
and proportionality, in addition to the guarantees inherent to the process. In view of
obtaining evidence without respecting the requirements, it is ingested in a prohibited test
case, that is, in a prohibition on the evaluation of the evidence in the process, a concept
that will be further developed in the present work.
