The purpose of this paper is to conduct a study and analysis of the legislation and jurisprudence regarding the legal concept known as guardianship and joint custody. Initially, we will make a conceptual differentiation between custody and guardianship, since it is especially important to differentiate them given that in any legal procedure of separation, nullity or divorce in which there are minors involved it will be necessary to determine who it will be awarded to. We will start by describing what is understood by joint custody and then proceed by reviewing some of the most relevant international regulations, which have served as the basis and inspiration for legislators. Later we will make an analysis from the contrastive law of countries in our European environment, such as France, Germany, Portugal and Italy. Next, the regulation of joint custody in our civil code is analyzed, beginning with the situation prior to the 2005 reform and then moving towards the change produced after said reform. We will continue with an analysis of the jurisprudence of the Supreme Court, examining the criteria to be taken into account for awarding or exclusion of joint custody. We will comment on the draft bill on the exercise of parental responsibility and other measures to be considered after the break of coexistence. We will follow by an analysis of the autonomous communities with their own legislation, which are Catalonia, Navarre, Aragon, Valencia and the Basque Country.
