This paper is aimed to make an approach to differentiate the typology of public employees, as well as a comparison between the public and private sector regarding the Disciplinary Regime, focusing on the sanctions and the procedure applicable to this process. For this purpose, a study of the disciplinary regime applicable to public personnel has been carried out, be it the EBEP for all of them and in particular the RD 33/1986 for the civil service and for the workforce its III Collective Agreement for the labor personnel at the service of the AGE. On the other hand, regarding the private sector the collective agreements applicable to the most important sectors of the province of Alicante have been analyzed. The results obtained show a great difference between the public sector and the private sector in the hardness of both the sanctions applicable to the same events, as well as the time for prescribing the absences, and also the procedure, which is more complex and longer for the public employees than in the private sector. Finally, the main conclusion obtained is that the Disciplinary Regime of the public sector presents a dissuasive nature, being more burdensome for its workers, but less used in practice. However, in the private sector, the procedure is more agile and simple with a diversity of possible sanctions which may lead to the dismissal of the worker more easily, if there is a duly accredited cause.
