In this undergraduate thesis, we address the impact and challenges posed by the emergence of artificial intelligence in the field of intellectual property. Specifically, we examine the issue of determining authorship of works generated by algorithmic systems, as the rapid advancement of this technology has created a legal situation that warrants a thorough analysis. The study begins with the conceptual framework and legal foundations of intellectual property. This analysis serves as a basis for examining the international, EU, and national frameworks through which intellectual property is regulated and, more specifically, AI in relation to copyright. All of this allows us to identify both the existence of a latent tension between these regulations and the results generated by systems equipped with artificial intelligence, as well as the limitations of such regulations and the difficulties this poses in practice. Subsequently, we examine the nature of these works and present the various doctrinal positions regarding whether or not they should be protected under intellectual property law. This analysis is complemented by a practical exercise designed and structured with the intention of verifying and deeply understanding these doctrinal foundations. Our ultimate aim is to rigorously demonstrate the need to adapt the legal framework and establish specific regulations with basic criteria to ensure the responsible use of AI in this area.es_ES
