dc.description.abstractLa desheredación constituye una de las instituciones más controvertidas del Derecho sucesorio, al situarse en el punto de equilibrio entre la libertad de testar y la protección de los herederos forzosos. En los últimos años, esta figura ha adquirido una especial relevancia debido a los cambios sociales y familiares, así como a la evolución de la jurisprudencia en materia de legítima y relaciones familiares. Este trabajo analiza la regulación de la desheredación desde una perspectiva de Derecho comparado, tomando como referencia los sistemas jurídicos de España, Italia, Portugal y Francia. A lo largo del estudio se examinan los fundamentos jurídicos de la legítima, las causas de desheredación y su evolución histórica en el ámbito europeo. Asimismo, se estudia el tratamiento que cada ordenamiento otorga a la libertad del testador y a la protección de los legitimarios, destacando sus principales diferencias y similitudes. También se aborda la creciente importancia del maltrato psicológico y la ruptura de los vínculos familiares como causas de exclusión sucesoria. Finalmente, el trabajo reflexiona sobre la necesidad de adaptar el Derecho sucesorio a la realidad social actual, valorando posibles reformas orientadas a lograr un equilibrio entre la autonomía de la voluntad y la solidaridad familiar.es_ES
dc.description.abstractDisinheritance constitutes one of the most controversial institutions within inheritance law, as it lies at the intersection between testamentary freedom and the protection of forced heirs. In recent years, this legal figure has gained particular relevance due to social and family changes, as well as the evolution of case law concerning compulsory heirship and family relationships. This paper analyzes the regulation of disinheritance from a comparative law perspective, focusing on the legal systems of Spain, Italy, Portugal, and France. Throughout the study, the legal foundations of compulsory heirship, the grounds for disinheritance, and their historical development within the European context are examined. Likewise, the paper explores how each legal system balances the testator’s freedom with the protection of forced heirs, highlighting their main similarities and differences. Special attention is also given to the growing importance of psychological abuse and the breakdown of family ties as grounds for exclusion from inheritance. Finally, the paper reflects on the need to adapt inheritance law to contemporary social realities, considering possible reforms aimed at achieving a balance between individual autonomy and family solidarity.es_ES
