Análisis sobre la organización de los testigos de jehová y el fenómeno sectario en España.

Abstract

El fenómeno sectario, a pesar de ser un concepto no tan debatido en la actualidad, en comparación con otros sucesos socialmente relevantes, es un elemento que ha pasado desapercibido en el ámbito jurídico y psicológico español, lo que ha dado como resultado una serie de repercusiones que afectan de manera negativa a los adeptos (o miembros) de estas organizaciones. El objetivo de este Trabajo es el de realizar un doble análisis, empezando por el estudio del concepto de secta destructiva así como el estudio de todos aquellos elementos propios o relacionados con este fenómeno, como por ejemplo la posición de la víctima como adepto o el control coercitivo. En segundo lugar, realizaré un análisis sobre la sentencia de 1ª Instancia de Torrejón de Ardoz, donde por primera vez se denominaron a los Testigos de Jehová como una secta de carácter destructivo. Por último, finalizaré el trabajo con una serie de propuestas, tanto jurídicas como criminológicas, que tengan como objetivo ayudar a aquellas víctimas que hayan sido afectadas por la influencia destructiva de las sectas, así como sugerir modificaciones legislativas que permitan un mejor control y actuación frente a este creciente problema del siglo XXI.

The cult phenomenon, despite being a concept not as debated today compared to other socially relevant events, is an element that has gone unnoticed in the Spanish legal and psychological field, carrying with it a series of repercussions that negatively affect the adherents (or members) of these organizations. The objective of this work is to carry out a double analysis, starting with the study of the concept of destructive cult as well as the study of all those elements proper or related to this phenomenon, such as the position of the victim as an adept or coercive control. Secondly, I will carry out an analysis of the 1st Instance ruling of Torrejón de Ardoz, where for the first time Jehovah's Witnesses were named as a destructive cult. Finally, I will conclude the work with a series of proposals, both legal and criminological, that aim to help those victims who have been affected by the destructive influence of cults, as well as legislative modifications that allow better control and action against this growing problem of the 21st century.
