El Dispositivo Electrónico de Control (DEC), su integración en la política del uso de la fuerza policial, y su eficacia para la protección de la seguridad ciudadana

Abstract

El presente trabajo de fin de grado tiene como objetivo principal abordar y dar respuesta a una serie de interrogantes surgidos tras la incorporación del DEC (Dispositivo Electrónico de Control) como arma de dotación de distintas Fuerzas y Cuerpos de Seguridad en nuestro país. Se analizarán entre otras cuestiones, la idoneidad de esta arma menos letal, para mejorar la eficacia operativa en el uso de la fuerza, especialmente en intervenciones de alta resistencia física o fuerte oposición violenta, sin incrementar el riesgo para la integridad física tanto para el agresor como para los agentes. Para ello se analizarán las bases jurídicas que la regulan el uso de la fuerza, tanto a nivel nacional como internacional, se llevará a cabo una aproximación a la tecnología DEC para poder abordar un análisis comparado de los nuevos protocolos operativos de los distintos cuerpos policiales. Finalmente, se examinará el acogimiento de este nuevo medio de fuerza por parte de los tribunales de justicia mediante el correspondiente análisis jurisprudencial.

The main objective of this final degree project is to address and, to the extent possible, answer a series of questions that may arise following the incorporation of the ECD (Electronic Control Device) as a service weapon for various law enforcement agencies in our country. Among other issues, it will analyze the suitability of this less-lethal weapon to improve operational effectiveness in the use of force, especially in interventions involving high physical resistance or strong violent opposition, without increasing the risk to the physical integrity of both the aggressor and the officers. To this end, the legal bases that regulate the use of force, both nationally and internationally, will be analyzed. ECD technology will be examined in order to conduct a comparative analysis of the new operational protocols of the various police forces. Finally, the acceptance of this new means of force by the courts of justice will be examined through jurisprudential analysis.
