La Ocupación Ilegal de Inmuebles, Aspectos Jurídicos e Intervención Policial

Abstract

El trabajo de investigación versará sobre el fenómeno de la ocupación ilegal de inmuebles. Con el objeto de conocer en profundidad su problemática, se realizará un análisis jurídico de las diferentes modalidades delictivas asociadas al mismo, como el delito de allanamiento de morada y el delito de usurpación pacífica de bienes inmuebles, para facilitar una labor Policial con mayor seguridad jurídica ante tales hechos ilícitos. Partiendo de sus distintas acepciones y una breve evolución histórica, la metodología empleada se centrará principalmente en el estudio de referencias bibliográficas y la medición de estadísticas referentes al número de denuncias y condenas por allanamiento y usurpación. Posteriormente se realizará un análisis jurídico a nivel penal, procesal, civil, administrativo y especialmente constitucional. Este análisis aportará casuística, jurisprudencia e instrucciones dictadas al respecto, así como flujogramas de actuación policial y una breve referencia a empresas dedicadas a la desocupación de inmuebles como por ejemplo la empresa “Desokupa”. Concluyendo el estudio se ofrecerán unas recomendaciones a nivel policial, centradas en la labor preventiva y las medidas prácticas a tomar en el día a día para abordar el fenómeno de la ocupación ilegal de inmuebles.

The research paper will focus on the phenomenon of the illegal occupation of real estate. With the aim of gaining an in-depth understanding of its problems, a legal analysis of the different criminal modalities associated with it will be carried out, such as the crime of trespassing and the crime of peaceful usurpation of real estate, to facilitate Police work with greater legal certainty in the face of such unlawful acts. Based on its different meanings and a brief historical evolution, the methodology used will mainly focus on the study of bibliographic references and the measurement of statistics referring to the number of complaints and convictions for trespassing and usurpation. Subsequently, a legal analysis will be carried out at the criminal, procedural, civil, administrative, and especially constitutional levels. This analysis will provide case studies, jurisprudence, and instructions issued in this regard, as well as police action flowcharts and a brief reference to companies dedicated to the eviction of real estate, such as the company "Desokupa." Concluding the study, recommendations will be offered at the police level, focusing on preventive work and the practical measures to be taken on a daily basis to address the phenomenon of illegal occupation of real estate.
