Garantías y derechos de los pasajeros en el transporte aéreo

Abstract

Este trabajo de fin de grado analiza los derechos y garantías que los pasajeros tienen en el transporte aéreo, como el propio título indica, y en qué marco normativo están recogidos. Además, se indica en qué situaciones les corresponden a los pasajeros estos derechos y de que forma pueden actuar para reclamarlos en caso de que las compañías aéreas no cumplan con su responsabilidad. Por último, se abordan una serie de sentencias del Tribunal de Justicia de la Unión Europea donde se pone de manifiesto que el Reglamento, marco normativo donde se recogen los derechos de los pasajeros, no es suficiente y se debe acudir a la justicia europea.

This final degree project analyzes the rights and guarantees that passengers have in air transport, as indicated by the title, and the legal framework in which they are established. Additionally, it specifies the situations in which passengers are entitled to these rights and how they can act to claim them if airlines fail to fulfill their responsibilities. Finally, it discusses a series of judgment from the Court of Justice of the European Union, that demonstrate that the Regulation, which serves as the legal framework for passenger rights, is not sufficient and that recourse to European justice is necessary.
