Feminismos y violencia de género

Abstract

Los feminismos son uno de los movimientos de mayor influencia social a nivel global que podemos observar hoy en día. Su importancia se plasma en la aparición de estudios, normativas, organismos y atenciones mediáticas que, mezclado a la velocidad con la que se mueven las sociedades actuales y los medios informáticos y de redes sociales existentes lo convierten en un fenómeno viral y de un recorrido imparable. En este trabajo nos adentraremos en buscar y explicar las claves de los feminismos, su transversalidad en todos los conceptos sociales actuales, prestando especial atención a la variable legal y legislativa, donde haremos especial hincapié en la normativa existente, su contenido y evolución. En su estudio observaremos que podemos encontrar referencias a diversas materias y en distintos ámbitos, existiendo normativas penales que, además, abarcan diversos delitos en los que el bien jurídico protegido se circunscribe a la defensa de los derechos de la mujer, y a la evitación, o al menos la sanción, de los actos que realiza el hombre sobre ella, y también normativa más asistencial y social con la que evitar y paliar los efectos negativos de cualquier tipo de acción agresora. Otro de los prismas que se va a desarrollar en este estudio es el referente a la vis política de esta ideología. Observaremos como, con sus matices positivos y negativos, los feminismos se han convertido en un caballo de batalla en el que se basan políticas propias, y derivadas de este fenómeno, utilizando el mismo como argumento y como excusa para justificar acciones, discursos y plasmar con ello hechos y normativas. Otra vía que se explorará es la relativa a la educación de las nuevas generaciones en esta temática en la que existe otra gran discusión social entre la necesidad de educar a los menores en principios feministas y la que lo observa como un adoctrinamiento. Otro gran marco de estudio será la situación de la igualdad y la no discriminación en la esfera laboral, tanto a nivel privado como de las administraciones públicas, y las medidas legales adoptadas para conseguir esos fines. Prestaremos una especial atención al ámbito policial y judicial y las posibilidades que ofrece la normativa en cuanto a ayudar la víctima y a responder de una forma efectiva contra el agresor y sus actos. Acompañaremos todos estos temas a tratar de estadísticas relacionadas con hechos, géneros y otras características humanas y sociales que justifiquen los argumentos presentados y ayuden a dar entender un tema tan actual y de tal variedad de matices.

Feminisms are one of the most socially influential movements at a global level that we can observe today. Its importance is reflected in the appearance of studies, regulations, organizations and media attention that, mixed with the speed with which today's societies move and the existing computer and social media make it a viral phenomenon with an unstoppable trajectory. In this paper we will look for and explain the keys of feminisms, their transversality in all current social concepts, paying special attention to the legal and legislative variable, where we will place special emphasis on the existing regulations, their content and evolution. In its study we will observe that we can find references to various matters and in different areas, there being criminal regulations that, in addition, cover various crimes in which the legal right is not a legal right protected is limited to the defence of women's rights, and to the avoidance, or at least the punishment, of the acts carried out by men on them, and also more welfare and social regulations with which to avoid and mitigate the negative effects of any type of aggressor action. Another of the prisms that will be developed in this study is the one referring to the political vis of this ideology. We will observe how, with its positive and negative nuances, feminisms have become a workhorse on which their own policies are based, and derived from this phenomenon, using it as an argument and as an excuse to justify actions, discourses and the embodiment of facts and regulations. Another avenue that will be explored is related to the education of the new generations in this subject, in which there is another great social discussion between the need to educate minors in feminist principles and the one that observes it as indoctrination. Another major framework of study will be the situation of equality and non-discrimination in the workplace, both at the private and public administration levels, and the legal measures adopted to achieve these ends. We will pay special attention to the police and judicial field and the possibilities offered by the regulations in terms of helping the victim and responding effectively against the aggressor and his actions. We will accompany all these topics to deal with statistics related to facts, genders and other human and social characteristics that justify the arguments presented and help to understand such a current issue with such a variety of nuances.
