El acceso al mercado laboral español de los teletrabajadores extranjeros. Algunas reflexiones tras un año de su regulación

Abstract

En el presente artículo se analizará qué se entiende por teletrabajo; para luego definir la figura del teletrabajador extranjero; a continuación, se verán los requisitos exigidos por el ordenamiento jurídico que puedan acceder un teletrabajador a residir en nuestro país distinguiendo de otras figuras afines contempladas en el Derecho de extranjería y se cierra este análisis con algunas valoraciones críticas a modo de conclusiones, las cuales resultan muy iniciales ya que este estudio es una primera aproximación a una investigación mucho más amplia sobre estos temas.

In this article we will analyse what is meant by telework; then we will define the figure of the foreign teleworker; then we will look at the requirements demanded by the legal system for a teleworker to be able to reside in our country, distinguishing from other similar figures contemplated in the Law on foreigners and we will close this analysis with some critical evaluations by way of conclusions, which are very initial as this study is a first approach to a much broader research on these issues.
