Problemas derivados de la doble nacionalidad hispano-lituana

Abstract

Este trabajo se hace con el propósito de conocer más en profundidad las consecuencias negativas que conlleva la inexistencia de la doble nacionalidad española y lituana y plantear las razones a favor de su adopción. Se realiza un estudio de los distintos métodos existentes tanto en la legislación española como en la lituana de adquirir su nacionalidad, y su restrictiva y rigurosa actitud a la hora de permitir la plurinacionalidad de sus ciudadanos. Además, se presenta el panorama actual de la Unión Europea, cuyos estados miembros están cada vez más interrelacionados y con una ciudadanía europea común, y como este rechazo a la doble nacionalidad por parte del Estado español y del Estado lituano impide el pleno disfrute de los derechos inherentes a los ciudadanos europeos. No se adaptan a la realidad actual, donde ya los límites fronterizos entre estados miembros son casi inexistentes y donde se anima a los ciudadanos europeos a hacer uso de su nuevo estatuto personal europeo y moverse al país miembro que deseen. Esta situación conlleva un gran perjuicio a los habitantes de dichos países, quienes deben tomar la difícil decisión de elegir entre mantener su vínculo con su Estado de origen o tener una vida plena en el país en el que han decidido establecerse, porque, por el momento, disponer de ambas cosas no es posible. Aunque a la luz de los recientes acuerdos firmados por parte de España, la iniciativa en Lituania de implementar un referéndum relativo a su plurinacionalidad y la gran importancia que está cobrando el derecho de la Unión, es posible que se vea un cambio a mejor pronto.

The aim of this paper is to gain a deeper understanding of the negative consequences of the non-existence of dual Spanish and Lithuanian nationality and to put forward the reasons in favour of its adoption. A study is made of the different methods existing in both Spanish and Lithuanian legislation for acquiring their nationality, and their restrictive and rigorous attitude when it comes to allowing the plurinationality of their citizens. Furthermore, it presents the current panorama of the European Union, whose member states are increasingly interrelated and with a common European citizenship, and how this rejection of dual nationality by the Spanish and Lithuanian states prevents the full enjoyment of the rights inherent to European citizens. They do not adapt to the current reality, where the borders between member states are almost non-existent and where European citizens are encouraged to make use of their new personal European status and move to the member state of their choice. This situation is very detrimental to the inhabitants of these countries, who have to make the difficult choice between maintaining their link with their state of origin or having a full life in the country where they have decided to settle, because at the moment it is not possible to have both. Although in the light of the recent agreements signed by Spain, the initiative in Lithuania to implement a referendum on its plurinationality and the growing importance of EU law, we may soon see a change for the better.
