Relación entre la calificación del concurso culpable y el delito de insolvencia punible

Abstract

Este trabajo pretende poner de manifiesto la relación tan estrecha que existe entre dos figuras de nuestro ordenamiento jurídico, aun perteneciendo a dos jurisdicciones distintas. Estas figuras son la calificación del concurso de acreedores como culpable, dentro de la jurisdicción civil/mercantil, y el delito de insolvencia punible, en la jurisdicción penal. De dicha relación surgen diferentes problemas o dudas, las cuales, se intentará resolver a lo largo del trabajo.

This work aims to highlight the close relationship that exists between two figures of our legal system, even belonging to two different jurisdictions. These figures are the qualification of the bankruptcy as guilty, within the civil/commercial jurisdiction, and the crime of punishable insolvency, in the criminal jurisdiction. From this relationship arise different problems or doubts which will be tried to solve throughout the work.
