La protección jurídica de los animales en España. Especial referencia a la sanción penal del maltrato animal

Abstract

El presente trabajo se ocupa de analizar el desafío que ha supuesto y supone a día de hoy para el Derecho español la regulación del maltrato animal; partiendo de su consideración jurídica, que ha evolucionado de bien semoviente a ser sintiente, con la reforma operada en el ámbito civil por la Ley 17/2021, de 15 de diciembre, y toda la andadura normativa en la materia en el ámbito penal hasta los arts. 337 y 337 bis del Código Penal que son los que actualmente tipifican en maltrato y el abandono animal tras la reforma operada por la Ley Orgánica 1/2015, de 30 marzo 2015, así como el Anteproyecto de Ley Orgánica de modificación de la Ley Orgánica 10/1995, de 23 de noviembre, del Código Penal.

The aim of the of present paper is to study the challenge that the regulation of animal mistreatment has posed and represents today for Spanish law; starting from its legal consideration, which has evolved from being an object to being sentient, with the reform operated in the civil sphere by Law 17/2021, of December 15, and all the regulatory steps in the sector in the criminal sphere up to arts. 337 and 337 bis of the Penal Code, which are the ones that currently typify animal abuse and abandonment after the reform operated by Organic Law 1/2015, of March 30, 2015, as well as the Draft Organic Law for the modification of Organic Law 10 /1995, of November 23, of the Penal Code.
