La Prevención de Riesgos Laborales en España: Real Decreto Ley de la policía minera 1897, origen y principales aportaciones

Abstract

En el presente trabajo de investigación, analizamos los hechos históricos que construyeron las bases de la Ley de Prevención de Riesgos Laborales en el sector de la minería en España. En primer lugar, analizaremos el contexto histórico en el que está desarrollado este trabajo, conociendo el origen de la prevención de riesgos laborales y las primeras normas que se aplicaron originalmente en esta materia y que se han ido desarrollando con los años. En segundo lugar, y como núcleo principal de este trabajo de fin de grado, profundizaremos en el Real Decreto Ley de la Policía Minera de 1897, desgranando su contenido, ya que, constituyó un pilar normativo fundamental siendo este el Real Decreto Ley el más significativo e importante para el desarrollo normativo en materia de prevención de riesgos en el sector de la minería en España. Por último, realizaré un análisis comparativo de las primeras normas respecto a las actuales, detallando la influencia que tuvieron esas normas en nuestros días y conociendo mejor la figura de la Policía Minera en la actualidad. Finalizando este trabajo con las conclusiones obtenidas tras el estudio del mismo.

In this research work, we analyze the historical facts that built the foundations of the Law on Prevention of Occupational Risks in the mining sector in Spain. In the first place, we will analyze the historical context in which this work is developed, knowing the origin of occupational risk prevention and the first regulations that were originally applied in this matter and that have been developed over the years. Secondly, and as the main core of this end-of-degree project, we will delve into the Royal Decree Law of the Mining Police of 1897, unpacking its content, since it constituted a fundamental normative pillar, this being the Royal Decree Law the most significant and important for the regulatory development in terms of risk prevention in the mining sector in Spain. Finally, I will carry out a comparative analysis of the first regulations with respect to the current ones, detailing the influence that these regulations had in our days and knowing better the figure of the Mining Police today. Completing this work with the conclusions obtained after the study of it.
