This research analyzes hate crimes from an interdisciplinary perspective: on
the one hand, we study their regulation in the Spanish Penal Code from the last reform
operated by the legislator in 2015. The aim is to clarify which aspects of Articles 22.4
and 510 present problems in terms of their practical application and which of them
represent an excessive irruption in the field of protection of fundamental rights, where
freedom of expression acquires special importance.
We also propose a strict lege lata interpretation, coherent and respectful of the principle
of criminal legality and, at the same time, teleologically oriented towards fulfilling the
function of ultima ratio of criminal law.
On the other hand, it examines how hate speech reaches the masses through mainstream
media journalism, as well as the degree of responsibility they have in the dissemination
of messages of a violent or discriminatory nature.
To this end, three cases have been selected that can be considered as hate crimes with
significant social repercussions in recent times: racist demonstrations against a refugee
camp in the Canary Islands, the news about a chat of former Spanish soldiers in which
violence was incited against a certain ideological sector of the population; and, ultimately, comments of a discriminatory nature published on the social network
Twitter. Therefore, it is intended to compare whether media coverage conforms to the
legal interpretation of these cases.
Consequently, a series of guidelines are proposed so that when journalists are faced with
hate speech, they can make a truthful, honest and knowledgeable treatment of the Legal
System in this matter.
Finally, the simultaneous use of legal and journalistic disciplines stands as a transversal
commitment to education rights in order to combat the heterogeneous effects caused by
hate crimes in our society.
