Derecho a la intimidad y a la protección de datos, ¿está siendo realmente respetado en Internet?

Abstract

En el trabajo que vamos a presentar abordamos las problemáticas que nos podemos encontrar a la hora de la protección de nuestros derechos fundamentales en internet, más concretamente, la protección de nuestro derecho a la intimidad y nuestro derecho a la protección de datos. Para ello ha sido necesario llevar a cabo un breve análisis de los derechos constitucionales vinculados al tema principal de este trabajo, recogidos en el artículo 18 Constitución Española –en adelante, CE-, exactamente 18.1 CE y el 18.4. También analizaremos y explicaremos el marco jurídico relacionado a los derechos anteriormente nombrados y a la jurisprudencia que ha tenido cierta relevancia a la hora de tratar con la protección de estos derechos frente a terceros. Finalmente una vez terminado el citado análisis reflexionaremos sobre algunos ejemplos que puedan o hayan vulnerado los derechos antes citados

In the present work, we address the problems we may encounter when it comes to the protection of our Fundamental Rights on the internet, specifically the protection of our Privacy and Data protection’s rights. For this it has been necessary to carry out a brief analysis of the constitutional rights linked to the main theme of this work, collected in article 18 CE, exactly in the 18.1 and 18.4. We will also analyze and explain the legal framework related to the previous mentioned rights and to the jurisprudence that has had some relevance when dealing with the protection of these rights against thirds. Finally, once the previous mentioned analysis is finished, we will reflect on some examples that have or may have violated this rights
