Victimización sexual de las mujeres en el ciberespacio

Abstract

En las últimas décadas el auge de Internet y las redes sociales han transformado las relaciones interpersonales, así como las interacciones entre víctimas y delincuentes. Los cambios en las rutinas de las personas, involucrando sus vidas cada vez más en la Red, han dado lugar a los cambios en la delincuencia. Asimismo, la delincuencia ha evolucionado de manera significativa trasladándose y adaptándose a los nuevos medios ofrecidos por el espacio virtual. Las víctimas y los delincuentes tienen un perfil distinto al tradicional y los delitos se han desarrollado incluso dando lugar a nuevas tipologías delictivas que han propiciado cambios en el Código Penal español. La delincuencia sexual, como tema principal del presente Trabajo Fin de Máster, ha buscado su espacio también en Internet. La gran mayoría de víctimas de delitos sexuales en el espacio físico son mujeres, pero en el ciberespacio se tratará de comprobar si el género de las víctimas difiere. Además, la imagen que otorgan los medios tecnológicos como las redes sociales o la pornografía, pueden influir en las conductas en Internet, dando lugar al acoso sexual o la sextorsión, que provocan grandes daños psicológicos en sus víctimas, entre otras. A lo largo de este trabajo se plantean dos objetivos, comprender las principales tipologías delictivas de índole sexual cometidas en el ciberespacio así como conocer la figura de la mujer como víctima de dichas conductas ilícitas. Estos dos objetivos se han logrado mediante una revisión bibliográfica tras una elección exhaustiva de aquellos textos que reunían las palabras clave además de otros datos de interés. Los resultados obtenidos demostraron que las mujeres son las grandes víctimas de los ciberdelitos sexuales tanto en España como en Europa, posiblente por diferentes factores de origen digital.

In recent decades, the rise of the Internet and social networks have transformed interpersonal relationships, as well as the interactions between victims and offenders. Changes in people's routines, involving their lives more and more on the Internet, have led to changes in crime. Likewise, crime has evolved significantly, moving and adapting to the new media offered by the virtual space. Victims and offenders have a different profile from the traditional one and crimes have even developed giving rise to new criminal typologies that have led to changes in the Spanish Penal Code. Sexual delinquency, as the main theme of this Master's Thesis, has also sought its space on the Internet. The vast majority of victims of sexual crimes in physical space are women, but in cyberspace we will try to verify if the gender of the victims differs. In addition, the image given by technological media such as social networks or pornography, can influence behavior on the Internet, leading to sexual harassment or sextortion, which cause great psychological damage to their victims, among others. Throughout this work, two objectives are proposed: to understand the main criminal typologies of a sexual nature committed in cyberspace as well as to know the figure of women as victims of said illicit behaviors. These two objectives have been achieved by means of a bibliographic review after an exhaustive choice of those texts that included the keywords as well as other data of interest. The results obtained showed that women are the great victims of sexual cybercrimes both in Spain and in Europe, possibly due to different factors of digital origin.
