Análisis del sistema de protección europeo de la marca UE

Abstract

En este Trabajo Fin de Grado dedicaremos un estudio enfocado al análisis del sistema de protección de la marca UE. Para ello, desmenuzaremos la estructura ideada por las insti-tuciones europeas para proteger las marcas de la Unión Europea. Con el objetivo de darle el enfoque más práctico posible, contemplaremos la legislación europea y española vigentes sobre la materia de marcas. De esta manera, conseguiremos concluir cuál es la interpretación seguida por la jurisprudencia sobre este campo. Para clarificar estas cuestiones, haremos hincapié en la noción de marca, sus funciones, las clases de marcas existentes, las diversas prohibiciones que nos podemos encontrar en medio de un procedimiento de registro, como los límites del ius prohibendi y la extinción de la marca. Todo ello, con el fin de comprender el funcionamiento del sistema de pro-tección de la marca UE. Al final del trabajo, finalizaremos el análisis sobre cómo registrar una marca en la Unión Europea, para dar paso a los límites que tienen los titulares de éstas en el ejercicio de sus facultades, como las causas de extinción que se pueden dar en las mismas.

In this Final Project we will devote a study focused to the analysis of the UE mark’s protection system. Because of that, we will cut up the structure invented by the european institutions to protect the community marks. With the objetive to give the most pragmatic focus posible, we will consider the current legislation about marks in Europe and Spain. In this way, we will get to conclude what’s the applied interpretation by jurisprudence in this field. In order to clarify these questions, we will emphasize in the mark concept, her functions, existing clases, different prohibitions which we may find in the middle of a registration procedure as the ius prohibendi limits and the mark extinction. All in order to understand the functioning of UE’s mark protect system. At the end of the Final Project, we will finish the exhaustive analysis done about how register a mark in the European Union, to give way to the limits that the holders of these have in the excercise of their faculties, such as the causes of extinction that can occur in them.
