El tribunal del jurado

Abstract

Este trabajo trata del Tribunal del Jurado en España. En el mismo examinaremos: el concepto, fundamento y naturaleza del jurado español; los diferentes modelos de jurado existentes ( anglosajón, mixto y escabinado) y la evolución de los mismos; repasaremos de forma breve la historia del jurado en España desde 1808 hasta la promulgación de la vigente LOTJ de 1995; el ámbito competencial del jurado; la composición del jurado y las funciones de sus diferentes miembros; el estatuto jurídico de los jurados: requisitos, capacidad, incompatibilidades, prohibiciones y excusas; el proceso de designación de los candidatos a jurados y de selección de los mismos; el procedimiento ante el Jurado y sus distintas fases: Fase de Instrucción, Fase Intermedia, Fase de Juicio oral, el Veredicto, la Sentencia y finalmente el sistema de Recursos.

This work deals with the Jury Court in Spain. In the same we will examine: the concept, foundation and nature of the Spanish jury; the different existing jury models (Anglo-Saxon, mixed and scattered) and the evolution of them; we will briefly review the history of the jury in Spain from 1808 until the promulgation of the current LOTJ of 1995; the jurisdiction of the jury; the composition of the jury and the functions of its different members; the juridical status of juries: requirements, capacity, incompatibilities, prohibitions and excuses; the process of appointing jury candidates and selecting them; the procedure before the Jury and its different phases: Instruction Phase, Intermediate Phase, Oral Trial Phase, the Verdict, the Judgment and finally the Resources system.
