La sustitución fideicomisaria como medio de protección patrimonial para las personas judicialmente incapacitadas

Abstract

Con la reforma de la Ley 41/2003 de 18 de noviembre de protección patrimonial se llevan a cabo una serie de modificaciones de gran importancia. Cabe destacar el nuevo precepto el artículo 808 CC, según el cual se faculta al testador para establecer una sustitución fideicomisaria que grave el tercio de legítima estricta, cuando uno de los hijos o descendientes sea incapacitado judicialmente. Este artículo no dice nada del tipo de sustitución fideicomisaria a aplicar, por lo que se entiende que se podrá establecer un fideicomiso de residuo, con las consecuencias que podría conllevar.
