Las diligencias de investigación tecnológica: Especial referencia a la intervención de las comunidades electrónicas

Abstract

La reforma de la Ley de Enjuiciamiento Criminal llevada a cabo en 2015 ha introducido cambios importantes en la materia de la investigación tecnológica. De esta manera, dicha reforma se ha ocupado a fortalecer las garantías procesales y también aclarar y completar la regulación deficiente que existía hasta entonces en este ámbito. Dado que la práctica de las diligencias de investigación tecnológica y, en particular, la intervención de las comunicaciones electrónicas puede vulnerar los derechos fundamentales tan importantes como el derecho al secreto de las comunicaciones o el derecho a la intimidad este tema resulta de gran importancia y por tanto se estudia en este trabajo.

The reform of the Law of Criminal Indictment carried out in 2015 has introduced important changes in the matter of the technological investigation. This way, the above mentioned reform has dealt to strengthen the procedural guarantees and also to clarify and to complete the deficient regulation that existed till then in this ambience. Since the practice of the procedure of technological investigation and, in particular, the intervention of the electronic communications can damage the fundamental rights as important as the right to the secret of the communications or the right to the intimacy this topic results from big importance and therefore it is studied in this work.
