El derecho y las nuevas tecnologías

Abstract

Partiendo de una introducción sobre el desarrollo de Internet y como ha ido evolucionando e introduciéndose cada vez más en la sociedad, iremos analizando como afecta a las distintas ramas del derecho con las que converge. En primer lugar hablaremos de la propiedad intelectual, y de cómo internet ha afectado a este derecho, cambiando su objeto, o mejor dicho, remodelando la protección del derecho pero adaptándolo a las nuevas exigencias que comporta esta era informática. Luego, ligado a la propiedad intelectual e industrial hablaremos sobre el comercio electrónico, analizando los tipos de contratos que surgen en relación al acceso a internet. Vinculado al comercio están las relaciones laborales, en las que las nuevas tecnologías han suscitado problemas en cuando a derechos fundamentales, o a la restricción de estos en el ámbito laboral. Posteriormente hablaremos de los delitos penales que han surgido a través de las redes, y las técnicas que componen cada tipo penal y del bien jurídico protegido en los delitos cibernéticos. Para terminar acabaremos relacionando el derecho constitucional, y más en concreto los derechos de intimidad, anonimato, honor y libertad de expresión, con el uso de las redes, y como pueden estas vulnerar dichos derechos. La conclusión versa sobre todos los cambios producidos y la necesidad de crear un régimen jurídico que regule las redes.

Starting from an introduction on the development of the Internet and as it has been evolving and introducing itself more and more into society, we will analyze how it affects the different branches of law with which it converges. In the first place we will talk about intellectual property, and how the internet has affected this right, changing its purpose, or rather, remodeling the protection of the right but adapting it to the new demands that this information age. Then, linked to intellectual and industrial property we will talk about electronic commerce, analyzing the types of contracts that arise in relation to Internet access. Related to trade are labor relations, in which new technologies have raised problems as to fundamental rights, or the restriction of these in the workplace. Later we will talk about the criminal offenses that have arisen through the networks, and the techniques that make up each criminal type and the legal good protected in cyber crimes. Finally we will end up relating the constitutional right, and more specifically the rights of privacy, anonymity, honor and freedom of expression, with the use of networks, and how can they infringe those rights. The conclusion is about all the changes produced and the need to create a legal regime that regulates the networks.
