La dignidad y la autonomía de las personas en el proceso de muerte. Un análisis jurídico de su regulación en España y de su desarrollo a nivel autonómico

Abstract

La dignidad acompaña a la persona durante toda su vida, y cuando la salud de las personas empeora, el ordenamiento jurídico debe garantizar que no se menoscabe, y esto incluye el proceso de muerte, que pertenece a la última fase de la vida de una persona. La dignidad de la persona y la autonomía de la voluntad constituyen el fundamento de toda la normativa autonómica. Se analiza la regulación estatal de la muerte digna, sus fundamentos, los derechos del paciente, como son el consentimiento informado, el acompañamiento, o la posibilidad de establecer su voluntad al final de la vida, dirigidos a las personas que sufren una enfermedad terminal, y se regulan también los deberes del personal sanitario respecto de las personas que se encuentran en el proceso de muerte. Además, se estudia la diferente regulación que tienen algunos estados de nuestro entorno como Holanda o Bélgica, que han avanzado en dicha materia.

Dignity accompanies the person throughout his life, and when the people's health gets worse, the legal system must ensure that it is not undermined, and this includes the process of death, which belongs to the last phase of a person's life. The dignity of the person and the autonomy of the will constitute the basis of all the regional regulations. It analyzes the state regulation of dignified death, its foundations, the patient's rights, such as informed consent, accompaniment, or the possibility of establishing their will at the end of life, aimed at people suffering from terminal illness, and also regulates the duties of the health personnel with respect to the people who are in the process of death. In addition, we study the different regulations that have some states of our environment like Holland or Belgium, which have advanced in this matter.
