La libertad religiosa, un análisis de sus principales retos

Abstract

El presente trabajo consiste en una aproximación – antecedentes, configuración, naturaleza, regulación…- a la libertad religiosa. Para ello ha resultado necesario analizar nuestra Constitución y reflexionar sobre sus motivos y consecuencias. Del mismo modo ha resultado imprescindible identificar las dificultades a las que se enfrenta a la hora de aplicarse. Problemas de los que nunca ha estado exenta la libertad religiosa, lógicamente por su naturaleza, y que va desde las resistencias en su reconocimiento hasta su aplicabilidad a cada situación. Con lo cual, es necesario llevar a cabo un análisis sobre esta libertad desde la perspectiva de sus límites y controversias, centrándonos especialmente en la libertad de expresión y en la aconfesionalidad del Estado junto a la posible discriminación de las religiones minoritarias. Como cierre del presente trabajo encontrarán algunas propuestas con el fin de resolver los conflictos que presenta este derecho a la libertad religiosa.

The present work consists of an approach - background, configuration, nature, regulation ... - to our right to the exercise of religious freedom. For this it has been necessary to analyze our Constitution and reflect on its motives and consequences. In the same way, it has been essential to identify the difficulties that this freedom faces when applying. Problems of which religious freedom has never been exempt, logically by its nature, and which goes from the problems of its recognition to its applicability to each situation. With this, it is necessary to carry out an analysis of this freedom from the perspective of its limits and controversies, focusing especially on the freedom of expression and on the non-denominational nature of the State together with the possible discrimination of minority religions. As a closing of the present work you will find some proposals in order to resolve the conflicts that this right to religious freedom presents.
