Nowadays it is difficult to distinguish between the public and private sphere of a person due to the content diffused on social media or published by the media. We talk specifically of privacy, a fundamental right guaranteed by the Spanish Constitution in Article 18. Its main function is to safeguard people's privacy over the rest of the citizens. There are many cases in which a means of communication violates the privacy of someone, thus prioritizing the right to information. Freedom of information is another guarantee collected by the Spanish Constitution whose objective is to allow the media to inform the public. These two rights enter in numerous occasions in conflict because the limits of one begin where the other begins. For there to be freedom of the press, two requirements must be met: veracity and relevance. On the opposite, to guarantee the right to privacy, one must take into account the predictability and the risk assumed. This is how we come to the subject in question of this work: the violation or not of the privacy of the exconseller Catalan Toni Comín and Carles Puigdemont, expresident of the Generalitat de Catalunya, after the publication of their messages. El Programa de Ana Rosa, broadcast on the Telecinco channel, published on January 31 an image showing the messages sent by Puigdemont to Toni Comín. In them, the former president made an allusion to a possible betrayal by other party members. After the publication of the photographs, the Catalan politicians declared that their right to privacy had been violated. In contrast, journalists claim a correct use of it based on the right to information. Throughout this work we wanted to explain what are the rights that can be opposed to press freedom. As well as giving a possible solution to the conflict between rights arising between El Programa de Ana Rosa and Toni Comín in accordance with the jurisprudence of the Constitutional Court.
