El cumplimiento de las normas de propiedad intelectual: hacia una comprensión de su prevalencia real y factores asociados

Abstract

ResumenEl presente artículo desarrolla las principales características acerca del diseño e implementación del proyecto InfractorXs. Con este proyecto se pretende abordar y estudiar los factores que inciden en la infracción de los derechos de propiedad intelectual por parte de hombres y mujeres en Internet. El objetivo es adquirir el conocimiento relevante capaz de informar la política legislativa a nivel de derecho público y privado. Para ello se parte de la hipótesis de que el cumplimiento de las normas está íntimamente relacionado con las intuiciones de justicia de la comunidad y de que el alto número de infractores de estos derechos en Internet no se distribuye de igual forma según el tipo de conducta y el género. A partir de aquí se pretende detectar hasta qué punto las percepciones sociales e individuales de la protección de los derechos de autor, así como del incremento de la probabilidad de que llegue a ser impuesta y ejecutada una sanción (derivado de un cambio en la práctica sancionatoria civil) incidiría en el efectivo respeto a tales derechos.

AbstractThis article develops the main features about the design and implementation of the InfractorXs project. The aim of this project is to address and assess the factors affecting the infraction of intellectual property rights by men and women on the Internet. The objective is to acquire relevant knowledge capable of informing legislative policy at the level of public and private law. This is based on the hypothesis that compliance with the rules is intimately related to the community’s intuitions of justice and that the high number of violators of these rights on the Internet is not distributed equally according to type of conduct and gender. The aim is to detect the extent to which social and individual perceptions of copyright protection, as well as the increased likelihood that a sanction (derived from a change in civil sanctioning practice) will be imposed and enforced, would have an impact on effective respect for such rights.
