dc.description.abstractEl presente Trabajo de Fin de Grado pretende analizar el cambio de paradigma que introduce la Ley 17/2021 al reconocer a los animales como seres sintientes, lo que rompe con la concepción tradicional del Código Civil que los trataba como simples bienes muebles. Este giro genera tensiones entre la teoría jurídica y su aplicación práctica, así como posibles incompatibilidades dentro del sistema civil. Aunque en España esta transformación es reciente, otros países ya habían abordado antes este debate, por lo que el trabajo incorpora una referencia a la evolución histórica y a las soluciones comparadas para contextualizar el cambio. El estudio examina cómo esta nueva categoría jurídica afecta a instituciones civiles como la propiedad, las sucesiones, la familia o los procedimientos de ejecución, y analiza los posibles problemas prácticos que surgen al aplicar la reforma. Todo ello sin perjuicio de incorporar propuestas de mejora que puedan integrarse en la práctica jurídica. La metodología se basa en el análisis sistemático de la legislación relevante —especialmente la Ley 17/2021—, así como de la doctrina científica, la jurisprudencia y otras fuentes especializadas, atendiendo siempre al sentido y finalidad de la reforma. Esta nueva consideración de los animales en Derecho Civil era necesaria, y totalmente justificada por la importancia que tienen estos seres en la sociedad. El problema es la estructuración incompleta, ya que se reconoce la singularidad del animal sin extraer de ella consecuencias jurídicas concretas ni concepciones o definiciones suficientes, lo que genera fricciones con instituciones civiles clásicas y consolidadas que el legislador no adaptó de forma coherente en su totalidad.es_ES
dc.description.abstractThis Final Degree Thesis aims to analyse the paradigm shift introduced by Law 17/2021, which recognises animals as sentient beings, thereby breaking with the traditional conception of the Civil Code that treated them as mere movable property. This shift generates tensions between legal theory and its practical application, as well as potential incompatibilities within the civil law system. Although this transformation is recent in Spain, other countries had already addressed this debate beforehand; accordingly, the thesis incorporates a reference to historical developments and comparative solutions in order to contextualise the reform. The study examines how this new legal category affects civil law institutions such as property, succession, family law, and enforcement proceedings, and analyses the practical problems that arise when applying the reform. It also puts forward improvement proposals capable of being integrated into legal practice. The methodology is based on a systematic analysis of the relevant legislation — most notably Law 17/2021 — as well as academic legal doctrine, case law, and other specialised sources, always bearing in mind the meaning and purpose of the reform. This new legal treatment of animals in civil law was necessary, and fully justified by the significance these beings hold in contemporary society. The problem lies in the incomplete structuring of the reform: it acknowledges the singular nature of animals without drawing from that acknowledgement any concrete legal consequences or sufficient definitions and conceptual frameworks, thereby generating friction with well-established classical civil law institutions that the legislature did not coherently adapt in their entirety.es_ES
