dc.description.abstractEste trabajo aborda la función garantista del seguro como institución jurídico-económica orientada a la protección del tomador frente al riesgo, integrando un enfoque técnico, normativo y doctrinal. A lo largo de sus seis epígrafes, se analiza la evolución del concepto de garantía aseguradora, la estructura de las provisiones técnicas, el papel institucional del contrato de seguro, y los mecanismos de supervi- sión pública que aseguran la transparencia y solvencia del sector. Desde la perspectiva normativa, se examinan los requisitos legales que configuran la actividad aseguradora, especialmente en lo relativo a la creación de provisiones, gestión prudente de activos y el cumplimiento de criterios de solvencia. Además, se analiza el contrato de seguro como herramienta de equilibrio entre autonomía privada y tutela pública, reconociendo su función social y la necesidad de un marco regulador firme que proteja al asegurado. El artículo dedica especial atención al papel de la Dirección General de Seguros y Fondos de Pensiones (DGSFP), cuya estructura y funciones —definidas por el Real Decreto 410/2024 y la Ley 40/2015— permiten articular una supervisión institucional eficaz y especializada. Se estudian sus com- petencias en materia de fiscalización, autorización y control normativo, así como su actuación proac - tiva frente a riesgos emergentes y desafíos tecnológicos. La parte final ofrece una reflexión crítica sobre el modelo asegurador actual y sus perspectivas de evolución. Se destacan líneas de mejora en la protección del consumidor, el fortalecimiento de la previsión social complementaria y el desarrollo de instrumentos regulatorios que respondan a las nuevas exigencias del mercado. El seguro se configura así no solo como un contrato, sino como una institución de cohesión jurídica y social, indispensable en el equilibrio del sistema económico-financiero moderno.es_ES
dc.description.abstractThis paper explores the guarantee-oriented function of insurance as a legal and economic institution aimed at protecting policyholders against risk, integrating technical, regulatory and doctrinal pers- pectives. Through six sections, it examines the evolution of the concept of insurance guarantees, the structure of technical provisions, the institutional role of the insurance contract, and the mechanisms of public supervision that ensure transparency and solvency across the sector. From a regulatory stan- dpoint, the study analyses the legal requirements shaping insurance activities, particularly in relation to the establishment of reserves, prudent management of assets and fulfilment of solvency criteria. It further examines the insurance contract as a mechanism for balancing private autonomy with public oversight, underlining its social function and the need for a robust regulatory framework that safe- guards the insured. Special attention is given to the role of the Directorate-General for Insurance and Pension Funds (DGSFP), whose structure and functions —as defined by Royal Decree 410/2024 and Law 40/2015— enable efficient and specialized institutional supervision. The analysis covers its powers in monitoring, authorization and regulatory development, as well as its proactive approach to emerging risks and technological challenges. The final section offers a critical reflection on the current insurance model and its future trajectory. It highlights areas for improvement in consumer protection, the rein- forcement of complementary social security, and the development of regulatory instruments adapted to new market conditions. Insurance is presented not merely as a contract, but as a legal and social institution essential for maintaining the balance of the modern financial systemes_ES
