dc.description.abstractEl trabajo es una primera aproximación a la novedad de la irrupción de los gemelos digitales, una tecnología originada en el sector industrial que ahora llega a la industria musical, generando impor- tantes retos jurídicos. Dada la necesidad de precisar la naturaleza del GD, se hace una aproximación a su estructura técnica, especialmente compleja en el caso del gemelo digital humano, basado en datos biométricos y entrenado mediante IA generativa. Su proceso de creación tiene una estrecha relación con técnicas de minería de datos (TDM), con los problemas que suscita el entrenamiento de obras protegidas por derechos de autor. En el ámbito musical, estos gemelos permiten recrear artistas y actuaciones, lo que exige consentimientos específicos, licencias sobre los materiales utilizados y protección de datos. Se analizan los inputs necesarios y las obligaciones legales derivadas, así como la naturaleza jurídica del output, que no constituye obra protegida. El estudio aborda también los riesgos de daño reputacional y la necesidad de prever responsabilidad contractual.es_ES
dc.description.abstractThe paper analyzes the emergence of digital twins, a technology originating in the industrial sector that has now reached the music industry, generating significant legal challenges. Given the need to clarify the nature of the digital twin (DT), the study offers an overview of its technical structure, which is particularly complex in the case of the human digital twin, based on biometric data and trained through generative AI. Its creation process is closely linked to text and data mining (TDM) techniques, raising issues related to the training of AI models on copyright-protected works. In the musical field, these twins enable the recreation of artists and performances, which requires specific consents, licenses for the materials used, and data-protection safeguards. The work examines the necessary inputs and the resulting legal obligations, as well as the legal nature of the output, which does not constitute a protected work. The study also addresses reputational risks and the need to anticipate contractual liability.es_ES
